@cathalmalone Yes fair enough, I meant to express is in practise, if some1 is in a State irregularly+doesn’t make an asylum claim (not excluding other possibilities), they are at risk of being deported. That is the essence. I didn’t take enough account for the finer comxplexities. Apologies.

To clarify, to lodge an asylum claim, you need to be in the territory of the State to which you are applying. You are not compelled to apply. But you lack the protections afforded to a/s if you don’t.
